DoT amends license granted to BSNL for satellite based services

The Department of Telecommunications (DoT) has amended in the sui-generis category license granted to BSNL for provision and operation of satellite based services using gateway installed in India for change in time period of storage of Call Detail Record.

The official circular by DoT states, “As per the Condition 5.1, Chapter-I of License Agreement for provision and operation of Satellite based services using gateway installed in India under “sui-generis” category, the Licensor reserves the right to modify at any time the License, if in the opinion of the Licensor it is necessary or expedient to do so in public interest or in the interest of the security of the State or for the proper conduct of telegraphs.”

The following amendment has been made:

Chapter VIII, clause 39, which specifies Security Conditions, sub-clause 39.20, has been substituted, namely:

“39.20 The Licensee shall maintain all commercial records/Call Detail Record (CDR)/Exchange Detail Record (EDR)/ IP Detail Record (IPDR) with regard to the communications exchanged on the network. Such records shall be archived for at least two year for scrutiny by the Licensor for security reasons and may be destroyed thereafter unless directed otherwise by the Licensor. Licensor may issue directions/instructions from time to time with respect to CDR/IPDR/EDR.”

Chapter VIII, clause 49, which specifies Security Conditions, sub-clause 49.8, has been substituted, namely:

“49.8 The Licensee shall maintain log- in/log-out details of all subscribers for services provided such as internet access, e- mail, Internet Telephony, etc. These logs shall be maintained for a minimum period of two year.”
