MeitY invites applications for appointment of whole time members of GAC

The government has invited applications for the appointment of whole time members of Grievance Appellate Committee(s) to consider appeals against decisions of Grievance Officers of intermediaries, including social media intermediaries, on complaints of violation of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Applications have been invited by Group Coordinator (Cyber Law Division), Ministry of Electronics and Information Technology at [email protected]. Last date for receipt of applications is January 12, 2023.

As per the government notification, The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 20211 made under the Information Technology Act, 2000 require intermediaries, including social media intermediaries, to observe due diligence while discharging their duties. Such due diligence includes the requirement that the intermediary shall make reasonable efforts to cause its users not to host, display, upload, modify, publish, transmit, store, update or share certain types of information. It also requires that the intermediary have a Grievance Officer to whom users or victims may complain about violation of the rules.

The notification further states that a person aggrieved by a decision of the Grievance Officer may prefer an appeal to the Grievance Appellate Committee, consisting of a chairperson and two whole time members. The committee shall adopt an online dispute resolution mechanism, wherein the entire appeal process, from filing of appeal to the decision thereof, shall be conducted through digital mode. Government may establish multiple such committees.
